Exactly. If it has no monetary value (despite whatever their "exchange rate says") and they can be removed for any reason that happens to float thier boats... they should either NOT allow people to spend $ for L$ and instead have some way for people to get the L$ ingame (omigod i called it a game O.O) like monthly allowences. (starting people with X amout of lindens would only result in endless characters created just to move those "newbie lindens" to thier character) The other logical choice is to put an actual value to the L$ (ie their "exchange rate") stick to it, and NOT remove L$ unless it proven that the L$ was gained fradulently AND they can prove who/how the fradulent charges occured by.

If Linden Dollars has no monetary value, then WHY do we have to purchase linden dollars in the first place. It should be given to us free of charge, after all, second life is like a make belief world, a fantasy world where the user can do anything he wants, such as running a virtual fake business, ect. Linden Labs should give every new account like $10,000 linden dollars to start, and if the account holder wants more he or she can operate a fake business to generate more lindens so he or she can buy more stuff or lands in second life.

I find NO sense whats so ever having to PAY to get lindens so then you confiscate my lindens WITHOUT REASON (like what you state on your TOS) that is robbery PLAIN AND SIMPLE. I Pay for Lindens, you take them away from me without reason and notice, you are stealing my money and I am pretty sure I will win in court if that case ever comes up. That provision of your TOS WILL get over thrown by a competent court of law because it is simply illegal. If it has no monetary value, you cannot charge for it, and for confiscation to occur there has to be a valid, legal reason behind it, you cannot just TAKE OTHER PEOPLE'S HARD HEARD MONEY away from them for no reason at any time. Please revise your TOS to say that money will only be confiscated if there is a valid reason behind it, the victim shall be given the opportunity to prove the contrary.

chmarr, I'm not defending Linden Lab's position on the matter. I think it's horrible what they did to you and to the other innocent fictims of this mess, and that docking the reciever for more than they recieved is just plain wrong. What I was stating in my last post was what they will almost certainly fall back on if they find themselves in court over the matter. I'm no lawyer though, and I would love to see a number of things in the TOS rewritten or ammended to make the rights of those who use SL a more fair and certain matter.

Ceera Murakami you said L$ has no monetary value.

well explane why i'm being forced to pay back nearly 2 million L$ even tho i did NOT have that money in the first place

2 million is almost $8,000 USD and all i had in my account was just over L$5000 and when i was made a victim of fraud its me being made to pay back something thats not worth anything

@Ceera: Just because the TOS says something, doesn't make it true. The arbitrary removal of a user's property is exactly the type of thing that *should* be decided in court so we can get past this notion that the "TOS is all that matters".

Bill? No, you'd likely lose the lawsuits. Because LL states clearly in their TOS that they have the right to seize assets for any reason or no reason at all, and that the L$ has no monetary value.

If somebody would give me, lets say 1 million lindens and linden labs seizes that based on their risk API program and implements the 150% penalty to my account and I am expected to pay the difference, I would sue linden labs because Linden lab's actions is without merit.

If, for some reasons, I were to operate a virtual business on second life and my legit business becomes a successful one and.... CATAPLUM!! Linden Labs decides to ban/disable my account and/or seize my money and/or implement the 150% penalty to my account based on their Risk API I would sue Linden Labs and collect damages.

I would win either lawsuits it if ever happens.

chmarr walcott, I was referring to the letter that Nexxus Ambassador wrote concerning accepting a donation for FurNation that he had checked out and in good faith took and then invested in FurNation as was agreed. He had stated in that letter that his acct, since he spent the donation, was placed into the negative when restored by LL. The link to his blog letter isn't working, but here is an article on the subject.

http://www.secondlifeinsider.com/2007/01/11/furnation-fraud/

"He was never told how this happened, nor what, if anything, LL was planning on doing to pursue the perpetrator. At this time, although Nexxus' account has been restored, he is in the red to the tune of over one million Linden dollars, and is considering closing up shop."

So you guys got hit in more ways than one I guess, that really sucks, I hope everything is resolved soon and better than it has been thusly, it would be ashamed if FurNation left SL.
